This policy explains how Moqana collects, uses, and shares personally identifiable information from its users, including through the Moqana mobile application (“Application”). By downloading, installing, accessing, or using the Application, you agree to the handling of your data in accordance with our Privacy Policy and these terms.
Financial Incentive Notification
Moqana Rewards is designed to thank and reward our loyal customers for supporting our business and purchasing our products. Customers can join Moqana Rewards by signing up online or through the Moqana App, where they can earn and collect "Coupons/Rewards" redeemable for benefits at participating Moqana stores. Moqana uses personal information you provide (like your name and email), along with data we collect automatically and information from other sources, to manage the Moqana Rewards program. This includes sending you promotional content and special offers as outlined in our Privacy Statement. We do not place a monetary value on the information collected through the Moqana Rewards program for email communications. You have the option to unsubscribe from commercial emails at any time by adjusting your account settings as described in the "How to Manage Your Account Settings" section, or by clicking the "unsubscribe" link in any commercial email we send. Participation in Moqana Rewards is voluntary. You can opt out by updating your preferences in the Account section of the Moqana iOS App, by submitting a request to delete your information using the provided form, or by contacting Moqana customer service. The value we derive from the Moqana Rewards program is based on an increase in customer loyalty and patronage, which may vary among members depending on their purchases and the offers they utilize, among other factors.
User Information
To fully utilize certain features of the Application, such as purchasing Moqana products using an iOS device in a manner similar to a Moqana stored value card (“Moqana Card”) for mobile payments, pre-ordering and paying for Moqana products prior to store arrival (“MOP”), including voice-command ordering (“Voice Ordering”), location-based enhancements, and accessing the user's address book, it is necessary to transmit user-provided information. This may include usernames and passwords, addresses, email addresses, phone numbers, financial details like credit card numbers, employer details, voice data, and GPS location (“User Information”).
To access features such as MOP and location-based services, users must enable “location services” within the Application and adjust their device's permissions to permit this data sharing. Similarly, for Voice Ordering, users must activate “microphone” and “speech recognition” settings within the Application or on their device. By using these features, users consent to the transmission and storage of User Information by Moqana and its agents as needed for the Application’s operation and as outlined in the Moqana Privacy Policy. For details on how Moqana uses and stores User Information and how to opt out, please refer to the Privacy Policy.
If users wish to use Application features to send messages or eGifts to third parties, they must first obtain the third party’s consent to share their personal details, such as name, phone number, or email address with Moqana. This information will be used solely to facilitate the requested service, like delivering an eGift.
Users are solely responsible for maintaining the confidentiality and security of all User Information transmitted or stored on their device for Application use, including all transactions and activities under their registered Moqana Card, whether authorized or not. Users must promptly notify Moqana of any unauthorized transactions or security breaches involving the Application. Moqana is not liable for losses incurred from the loss or theft of User Information from users’ devices, or from unauthorized or fraudulent transactions associated with the Application.
Email Alerts, Mobile Alerts, and In-App Notifications
When a user registers for a Moqana account through the Application, they are automatically enrolled to receive promotional emails from Moqana (“Email Communications”). However, users have the option to opt out of these Email Communications during the sign-up process. After registration, users can also discontinue Email Communications at any time by adjusting their profile settings on their Moqana account at www.moqanahouse.cafe.
Additionally, when downloading the Application, users are given the choice to receive push notifications on their device. These notifications may include promotional messages, offers, and system updates (“Push Notifications”). Users can opt out of receiving Push Notifications at any time after the Application is downloaded by turning the “Moqana Notifications” switch in the Application settings to “off,” or by disabling them in the device’s settings under "Notifications". Opting out of Push Notifications does not impact settings for Email Communications.
Lastly, by using this Application, in-app messages will automatically appear on the user’s display tiles or be sent to the Application’s Inbox, which may include promotional messages and offers. If a user prefers not to receive these in-app messages, they should discontinue use of the Application.
